40, 110, 610, 582 e 585, in relazione agli artt. 577 e 61 n. 4
c.p., così diversamente qualificati i fatti come descritti e
contestati in rubrica, per non aver commesso il fatto.
Letto l´art. 530 c.p.p., assolve LODESERTO Cesare e
LODESERTO Giuseppe dal reato loro ascritto al capo B della
rubrica per non aver commesso il fatto.
Letti gli artt. 538 e ss c.p.p., condanna LODESERTO Cesare,

fatta eccezione per Haddaji Mohammed, e con esclusione di Agrebi
Baligh e Aidi Manjoub con esclusivo riferimento a Lodeserto
Cesare e Dokaj Paulin, da liquidarsi in separato giudizio.
Condanna gli imputati al pagamento di una provvisionale pari
a € 2000 per ogni parte civile costituita, eccezion fatta per
l´Associazione Studi Giuridici sull´Immigrazione (ASGI).
Pone a carico degli imputati le spese di costituzione e
rappresentanza delle parti civili che liquida in euro 5000 per
la parte civile assistita dall´Avv. Pistelli, euro 7000 per le
parti civili assistite dall´Avv. Petrelli, euro 15000 per le
parti civili assistite dall´Avv. Petrelli, oltre IVA, CA e spese
forfetizzate come per legge.
